Welcome to Wearing West. Wearing West ("we", "us", "our") operates wearingwest.com (the "Site") as a curated directory and discovery platform that showcases independent fashion brands and designers. We do not sell, stock, warehouse, or ship any products, and we are not a party to any transaction between you and a brand. These Terms of Service (these "Terms") describe your rights and responsibilities when you use the Site.

Please read these Terms carefully, as they include important information about your rights and our disclaimers of liability. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy (wearingwest.com/policies/privacy-policy). If you do not agree, please do not use the Site.

Section 1 - What Wearing West Is
Wearing West is an informational resource. We publish descriptions, images, and other information about independent brands and their products to help you discover items that may interest you. Where available, we link out to a brand's own website (for example, via a "Shop Now" button) so that you can view and, if you choose, purchase that brand's products directly from the brand.

We do not process orders, collect payment, set prices, determine availability, or handle shipping, delivery, returns, or refunds for any product shown on the Site. Any purchase you make is a transaction solely between you and the applicable brand, governed by that brand's own terms of service, privacy policy, pricing, and shipping/return policies.

Section 2 - Accuracy of Information
All information on the Site, including brand descriptions, pricing references, availability, and shipping estimates, is provided for general informational purposes and is subject to change without notice. This information is supplied or sourced from the brands themselves and has not been independently verified by us. We encourage you to confirm all details directly with the brand before making any purchasing decision. Wearing West is not responsible for inaccuracies, omissions, or changes made by the brands listed on the Site.

Section 3 - Account and Access
To use certain features of the Site, such as saving items to your favorites or wishlist, you may be asked to create an account or provide certain information, such as your email address. You represent that you are at least the age of majority in your state, province, or country of residence. You are responsible for maintaining the security of your account credentials and for all activity on your account.

Section 4 - Intellectual Property
The Site, including its design, text, graphics, and the selection and arrangement of content, is owned by Wearing West or its licensors and is protected by applicable intellectual property laws. Brand names, logos, and product images displayed on the Site remain the property of their respective brands. These Terms permit you to use the Site for personal, non-commercial use only. You must not reproduce, distribute, modify, or create derivative works from the Site's content without our prior written consent or that of the relevant rights holder.

Section 5 - Third-Party Websites and Brands
The Site contains links to websites and social media pages operated by independent, third-party brands. These sites are not owned or controlled by Wearing West. We are not responsible for the content, accuracy, products, pricing, shipping, returns, privacy practices, or terms of service of any third-party site. If you choose to visit or transact with a brand's website, you do so at your own risk and subject to that brand's own terms and policies. Our inclusion of a link does not constitute an endorsement of the brand or its products.

Section 6 - Optional Tools and Features
The Site may provide access to tools such as search, filters, favorites/wishlist, and similar features. These are provided "as is" and "as available," without warranties of any kind. We may modify, suspend, or discontinue any feature at any time.

Section 7 - Feedback and User Content

Section 11 - Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WEARING WEST WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR RELIANCE ON INFORMATION PUBLISHED ON THE SITE, OR FROM ANY TRANSACTION, DISPUTE, PRODUCT, SHIPMENT, OR RETURN INVOLVING A THIRD-PARTY BRAND. WEARING WEST IS NOT A PARTY TO, AND ASSUMES NO RESPONSIBILITY FOR, ANY PURCHASE YOU MAKE FROM A BRAND FEATURED ON THE SITE.

Section 12 - Indemnification
You agree to indemnify and hold harmless Wearing West and its officers, employees, and agents from any claims, damages, or liabilities, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

Section 13 - Termination
We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms.

Section 14 - Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wearing West regarding the Site.

Section 15 - Governing Law
These Terms are governed by the laws of the state where Wearing West is headquartered, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise based on your country or state of residence.
